
Competency Evaluations
IN-HOME COMPETENCY EVALUATIONS
Dr. Van Kleeck is a licensed psychologist who has been working with seniors for almost thirty years. He travels to homes of elders to help determine if the elder is competent to make informed decisions regarding medical care and/or financial matters. If the elder is thought to be incompetent to make informed decisions, Dr. Van Kleeck provides a medical certificate (on the day of the evaluation) that is later presented to a judge for consideration.
EVALUATING FOR COMPETENCY
Competency refers to an adult's ability to weigh the pros and cons required to make an informed decision. The following takes place during the evaluation:
GUARDIANSHIP/CONSERVATORSHIP
Dr. Van Kleeck has performed hundreds of in-home evaluations to determine guardianship and/or conservatorship. If an elder is considered incapacitated, a medical certificate is completed on-site and given to the appropriate person.
TESTAMENTARY COMPETENCE
Dr. Van Kleeck travels to an attorney's office on the day a will is to be signed to determine if the elder has, testamentary capacity. Dr. Van Kleeck determines whether or not the elder, at the time of making the will, had a psychiatric disorder, a medical condition, a cognitive impairment, or, had undue influence (manipulation,deception, intimidation by others) which could affect the elder's ability to make a will. In addition, the evaluation considers whether or not the elder, at the time of making the will, had the capacity to understand, know, or recognize:
Adult siblings often disagree about the extent of their parents's memory impairment and the best course of action to help their parent. Dr. Van Kleeck performs an extensive evaluation of the elder and then helps the family to resolve differences and implement appropriate services and treatment.
EMERGENCY SITUATIONS
Dr. Van Kleeck is available for urgent matters where the elder may need to be immediately hospitalized against his/her wishes due to extreme safety concerns. Dr. Van Kleeck will arrange for emergency hospitalization on a geriatric psychiatry unit and provide a Section 12 for involuntary transportation.
WHO CALLS DR. VAN KLEECK?
Finally, Dr. Van Kleeck not only provides a typed report before leaving the attorney's office, but has also signed wills as a witness.
Appointments are usually arranged within a week and are performed in a variety of settings including private homes, attorney's offices, assisted living facilities, and nursing homes.
